These terms govern your use of the Bac Water Co. website and the purchase of our products. Please read them carefully.
Acceptance of terms
By accessing this website or placing an order, you agree to these terms. If you do not agree, do not use the site or purchase our products.
Research Use Only
All products supplied by Bac Water Co. are sold strictly For Research Use Only. They are not drugs, medical devices, cosmetics, or food, and are not intended for human or veterinary use, diagnosis, treatment, or consumption. By ordering, you represent that you are a qualified business, laboratory, or research purchaser and that you will use and store the products lawfully and only for permitted research purposes.
Eligibility
The site and products are intended for business and research customers who are at least 18 years old and legally able to enter into contracts. You are responsible for ensuring your purchase and intended use comply with all laws and regulations applicable to you and your jurisdiction.
Quotes and orders
Published prices apply to the listed stock-glass tray quantities; shipping and taxes are calculated separately for each order. A quote becomes binding only when an order is confirmed in writing by Bac Water Co. Stock wholesale starts at 252 vials for 10 mL glass or 304 vials for 30 mL glass. Private-label orders require at least 1,000 units per product and label design. We may decline an order before confirming it.
Payment terms
Orders are prepaid by card or bank transfer unless approved net terms apply. Wholesale customers may submit an application for net terms. All prices exclude applicable taxes, duties, and shipping unless stated otherwise on your quote or invoice.
Shipping and risk of loss
In-stock orders ship within 48 hours. Parcel orders ship by UPS or FedEx, and larger case or pallet orders ship by tracked freight. International shipping is available by quote. Delivery dates are estimates, and Bac Water Co. is not responsible for carrier delays outside its control. Title and risk of loss pass to you upon delivery to the carrier unless otherwise agreed in writing.
Returns and order issues
Products are nonreturnable after shipping except when they arrive damaged, are the wrong product, are defective, or do not meet documented specifications. Report an eligible issue within five business days of delivery to [email protected] and include photos and the product lot number. After review, Bac Water Co. may replace the affected product, issue a credit, or provide a refund. Custom products are final after artwork approval except for a defect or failure to meet documented specifications. Opened, mishandled, or improperly stored products are not eligible for return, credit, replacement, or refund.
Cancellations
Stock orders may be cancelled before fulfillment begins. Custom orders may be cancelled before artwork approval. After artwork approval or production begins, cancellation requires written agreement from Bac Water Co., and the customer remains responsible for costs already committed.
Private label
Customers may provide finished artwork or provide brand assets for Bac Water Co. to prepare a label layout. Production begins after artwork approval. Typical lead time is 1-3 weeks after artwork approval, and the final schedule is stated in the quote. You are responsible for rights to all artwork and brand assets you provide and for approving the final label.
Buyer responsibility and compliance
You are solely responsible for the handling, storage, labeling, and lawful use of products after delivery, and for any onward sale or distribution, including under a private label. You agree to comply with all applicable laws and to not represent the products as approved for any human or veterinary use.
Disclaimer of warranties
Products are provided "as is" to the specifications stated on the applicable Certificate of Analysis. To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, Bac Water Co. will not be liable for any indirect, incidental, special, or consequential damages, and our total liability arising out of any order will not exceed the amount paid for the products giving rise to the claim.
Intellectual property
The site, its content, logos, and product presentation are owned by Bac Water Co. or its licensors and may not be copied or used without permission.
Applicable law and changes
These terms are governed by applicable law. We may update these terms from time to time; the date below reflects the latest revision.
